User agreement

This User Agreement describes and governs the interaction of users with the official website of the ART Hotel and establishes the procedure for users' use of the services and materials posted on the Website.

1. Terms and Definitions

Website: the results of intellectual activity protected by law, including texts, graphic elements, images, design, logos and visual interfaces, located on the Internet under the domain name «arthotel30.ru», containing information about the services and the service provider, and enabling the selection and receipt of services.

Website Administration (the Administration): employees authorized to manage the Website, acting on behalf of the owner and (or) an authorized user of the Website.

Website User (the User): a person who has access to the Website via the Internet and uses the Website.

2. General Provisions

2.1. The use of the Website is governed by the current legislation of the Russian Federation.
2.2. A condition for the User's use of the Website is the User's full acceptance of this User Agreement and the Privacy Policy posted on the Website. Viewing the Website and (or) using its tools constitutes confirmation of the User's acceptance of the terms of this User Agreement.
2.3. If the User does not agree with the terms of this User Agreement, the User undertakes to leave the Website immediately and not to use the Website tools to perform any actions.

2.4. The Administration reserves the right to change, add or delete clauses of this User Agreement at any time without notifying the User. The User shall independently monitor changes to the User Agreement and bears the risks associated with such changes.

2.5. This User Agreement enters into force from the moment it is posted on the Website.

3. Subject of the Agreement

3.1. The subject of this Agreement is the provision to the User of access to the information contained on the Website about the hotel services rendered by the hotel and the procedure and terms of their rendering and provision, as well as access to direct booking of the hotel's services in accordance with the Rules for the Provision of Hotel Services in the Russian Federation approved by Resolution of the Government of the Russian Federation No. 1912 of 27.11.2025.
3.2. The Website provides the User with the following services: search and navigation on the Website, information about a service, its composition and quality, visual and contact information about the hotel, and a booking module.

3.3. This User Agreement describes and governs all services of the Website existing at the time the User visits the Website, as well as any subsequent modifications thereof and any improvements introduced in the future.

3.4. Access to the Website is provided free of charge.

3.5. The booking module operates through the Bnovo partner program, for whose operation the right holder of the booking module is responsible. Information about the booking module is available on the program developer's website https://bnovo.ru/. The User's use of the booking module on the Website means the User's acceptance of the terms of use of the booking module posted on the developer's website.

4. Rights and Obligations of the Parties

4.1. The User has the right to:

4.1.1. Use all services available on the Website;

4.1.2. Receive reliable information regarding the services of the Website through the communication channels indicated on the Website;

4.1.3. Use the Website solely for the purposes and in the manner provided for by this User Agreement and by means not prohibited by the legislation of the Russian Federation;
4.1.4. Post links to the Website and share information from the Website with an unlimited number of persons for the purpose of building a positive image of the Website and the ART Hotel.

4.2. The Website User undertakes to:

4.2.1. Provide, at the request of the Administration, additional information about the User that is directly related to the services provided by this Website.
4.2.2. Respect the property and non-property rights of authors and other right holders when using the Website.

4.2.3. Not take any actions that may be regarded as disrupting the normal operation of the Website.

4.2.4. Compensate the Administration for damages, including lost profits, if the User's actions cause harm, such as limiting the operability of the Website, significantly reducing the bandwidth of the Website's communication channel, altering and/or distorting information on the Website, or blocking or otherwise negatively affecting the Website.
4.2.5. Not disseminate, by means of the Website, any confidential information about individuals or legal entities protected by the legislation of the Russian Federation.
4.2.6. Avoid any actions that may result in a breach of the confidentiality of information protected by the legislation of the Russian Federation.

4.2.7. Not use the Website to disseminate advertising information except with the consent of the Administration.

4.2.8. Not use the services of the Website for the purpose of:

4.2.8.1. committing unlawful acts;

4.2.8.2. creating threats to national security or facilitating terrorist activity;
4.2.8.3. inciting ethnic hatred;

4.2.8.4. violating the rights of minors and (or) causing them harm in any form;
4.2.8.5. corrupt practices;

4.2.8.6. misleading the Administration.

4.2.9. Provide reliable information to the Administration.

4.2.10. Ensure that personal data is protected from access by third parties.

4.3. The User is prohibited from:

4.3.1. Using any devices, software, procedures, algorithms and methods, automated devices or equivalent manual processes to access, acquire, copy or monitor the content of the Website.

4.3.2. Disrupting the proper functioning of the Website.

4.3.3. Circumventing in any way the navigation structure of the Website in order to obtain or attempt to obtain any information, documents or materials by any means not specifically provided by the services of this Website.

4.3.4. Gaining unauthorized access to the functions of the Website, any other systems or networks related to this Website, or any services offered on the Website.
4.3.5. Violating the security or authentication system on the Website or in any network related to the Website.

4.3.6. Performing a reverse lookup, tracking or attempting to track any information about any other User of the Website.

4.3.7. Using the Website and its Content for any purposes prohibited by the legislation of the Russian Federation, or inciting any illegal activity or other activity that violates the rights of the Website or other persons.

4.4. The Administration has the right to:

4.4.1. Change the rules for using the Website and change the content of this Website. Changes enter into force from the moment the new version of the Agreement is published on the Website.
4.4.2. If signs of the User's actions referred to in subclauses 4.3.1. - 4.3.7. are detected, restrict the User's access to the Website, identify the Website User by available means, and report such actions to law enforcement authorities.
4.4.3. Disclose information about the User if the current legislation of the Russian Federation requires such disclosure.

4.5. The Administration shall not be liable for damage caused to the User as a result of actions taken by the User independently on the basis of information posted on the Website.

5. Use of the Website

5.1. The Website and the Content forming part of the Website are owned and managed by the Administration.
5.2. The Content of the Website is protected by copyright, trademark legislation and other rights related to intellectual property, as well as by unfair competition legislation.

5.3. This Agreement extends to all additional provisions and terms of service provided on the Website.

5.4. Information posted on the Website shall not be construed as an amendment to this Agreement.
5.5. The Administration has the right at any time, without notifying the User, to make changes to the list of services offered on the Website and (or) their prices.

6. Liability

6.1. Any losses that the User may incur as a result of an intentional or negligent breach of any provision of this Agreement, as well as a result of unauthorized access to the communications of another User, shall not be reimbursed by the Administration.

6.2. The Administration shall not be liable for:

6.2.1. Delays or failures in the course of a transaction arising from force majeure, as well as from any malfunction in telecommunication, computer, electrical and other related systems.

6.2.2. The proper functioning of the Website if the User does not have the technical means necessary to use it, and the Administration bears no obligation to provide users with such means.

6.2.3. The correctness of data entered by the User.

7. Breach of the Terms of the User Agreement

7.1. The Administration has the right to disclose information about the User if the current legislation of the Russian Federation requires or permits such disclosure.
7.2. The Administration may, without prior notice to the User, terminate and (or) block access to the Website if the User has breached this Agreement or the terms of use of the Website contained in other documents, as well as in the event the Website ceases to operate or due to a technical malfunction or problem.

7.3. The Administration shall not be liable to the User or third parties for terminating access to the Website if the User breaches any provision of this Agreement or of any other document containing the terms of use of the Website.

9. Additional Terms

9.1. Any demands and claims of the User regarding hotel services, accommodation services, the operation of the Website, or withdrawal from contracts shall be sent by email to info@arthotel30.ru or by post to: 87 Kirova St., Astrakhan, 414000. Please include your booking number, email address and telephone number in your request so that the matter can be resolved promptly.

9.2. User reviews posted on the Website are not confidential information and may be used by the Administration without restriction.
